Minecraft Server Hosting and Software License Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of services provided by the company: Visualmodder by Canonica (“we”, “us”, or “our”), including:

  • Minecraft server hosting with support, and
  • Self-hosted use of our proprietary VisualModder plugin under a software license without hosting or support.

By purchasing, accessing, or using any of our services or software, you agree to be bound by this Agreement and our Privacy Policy. If you do not agree with any part of these terms, you must not use our services.

1. Service Types

1.1 Hosted Server with Support (Standard Service)

This includes:

  • A dedicated Minecraft server hosted by us
  • Pre-installed VisualModder plugin
  • Basic technical support on a best-effort basis

1.2 Software License for Self-Hosting (Software-Only)

We offer the option to license the VisualModder plugin for independent, self-hosted use. This license:

  • Does not include any technical support, updates, or server hosting
  • May be subject to license verification
  • Each license is limited to use on a single server and may only be used by the number of users specified in the license agreement.

Use of the software without a valid license is strictly prohibited.

2. Customer Responsibility for Updates

2.1 It is the customer’s responsibility to regularly review this Agreement and stay up to date with any modifications. Continued use of the service or software constitutes acceptance of the latest version of these terms.

3. Payment Terms

3.1 Payment is required at least two 2 weeks prior to each monthly renewal.

3.2 Refunds will only be issued in cases where service disruptions are directly caused by us.

3.3 Late or missing payments may result in service suspension or termination.

4. Service Cancellation

4.1 Cancellation must be requested at least one (1) month before the renewal date.

5. Acceptable Use

5.1 The services and software may not be used for:

  • Delivering or supporting paid online courses (e.g., Udemy, Skillshare)
  • Illegal or malicious activities
  • Commercial resale or sublicensing without written permission

5.2 Misuse, unauthorized redistribution, or breach of terms may result in immediate termination of access or license.

6. Data Backup and Loss

6.1 we are creating and maintaining backups for our customers using hosted services, but we don’t accept any liability for backup loss, accidental deletion, or corruption.

6.2 We accept no liability for any data loss, accidental deletion, or data corruption resulting from the use of our software or any actions taken by us in the management or maintenance of the servers.

6.3 We are not responsible for any damages, losses, or service interruptions, whether due to hardware failure, software issues, or other causes.

7. Limitation of Liability

7.1 All services and software are provided on an “as-is” and “as-available” basis.

7.2 We shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use our services or software, including but not limited to:

  • Data loss
  • Downtime or unavailability
  • Financial or reputational damages

8. Software Licensing (Self-Hosted Use)

8.1 The VisualModder plugin may only be used under a valid license granted by us.

8.2 Licenses are granted per server instance and are non-transferable.

8.3 License misuse, duplication, or tampering may result in revocation without refund.

8.4 We reserve the right to validate licenses periodically through automated means.

8.5 We only provide support for the latest version of the software. Upgrades to newer versions are included free of charge, and updated versions will be made available for download.

9. Modifications to Terms

9.1 We reserve the right to modify this Agreement at any time.

9.2 It is the customer’s responsibility to remain informed about the latest version of these terms.

10. Governing Law and Jurisdiction

10.1 This Agreement is governed by the laws of Switzerland.

10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of the Canton of Ticino, Switzerland.

11. Minecraft Updates

11.1 For hosted services, we aim to maintain compatibility with the latest stable Minecraft version.

11.2 During updates, customers may temporarily need to use an earlier game version.

12. Reselling

12.1 Reselling or sublicensing of services or software is strictly prohibited without our express written consent.

13. Legal Notice

13.1 Visualmodder by Canonica is not affiliated with Mojang AB, Microsoft, or Notch Development AB.
